  • The price is based on two factors - the number of questionnaires and the number of users.
  • The questionnaires can be purchased on a 'mix & match' basis.  There are a total of 40 questionnaires available, simply select the number of questionnaires you want and the number of users.

Online Licence Terms & Conditions

Basis of the Sale

The Seller is Pearson Assessment, a division of Pearson Education Limited registered in England and Wales under company number 872828 at Edinburgh Gate, Harlow, Essex, CM20 2JE, United Kingdom. By purchasing the Seller’s products or Online Development Tools, the Purchaser agrees to these terms and conditions.

Definitions

“The Online Development Tools” mean all versions of the Honey and Mumford Learning Styles Questionnaire, including interactive Online Development Tools and parts thereof known as the Learning Series and the Behaviour Series.

“The Purchaser” means any person buying any of the Online Development Tools.

“User” means the Purchaser and its employees only.

Specifications

The Seller reserves the right to make changes in any version of its Honey and Mumford Learning Styles Questionnaire, its interactive Online Development Tools, The Learning Series and The Behaviour Series, and all component questionnaires, together known as ‘the Online Development Tools’. The Purchaser may request changes and the Seller will quote prices for any required changes.

Price

The price of the Online Development Tools shall be the price listed in the Seller’s price list current at the date of acceptance of the order, unless otherwise agreed. This price is exclusive of applicable Value Added Tax. Prices are quoted in GB Pounds. All prices in the Seller’s price list are confidential and should not be disclosed to other parties without the expressed written permission of the Seller.

Payment

The Purchaser will be invoiced in advance. The Seller will only make the Online Development Tools available after receipt of payment in full. The Seller will discontinue provision of the Online Development Tools if payment is not made.

Interactive Online Development Tools

The Purchaser will purchase a licence for a period of 12 months (‘the Licence Period’) from the date of purchase to supply the Online Development Tools to a maximum number of users. The Seller will raise an invoice related to the maximum number of users. If this number of users is exceeded, the Purchaser may purchase a new licence.

Intellectual Property

The Seller retains copyright and all intellectual property rights in the Online Development Tools, which must not be copied or reproduced in any form or posted onto a website or intranet without the Seller’s prior written approval. If the Purchaser does any act which, in the Seller’s reasonable opinion, is in breach of the Seller’s intellectual property rights, the Seller may terminate this agreement immediately, without prejudice to any other remedies the Seller may have.

Data Protection and Privacy

The Seller is registered and complies with the requirements of the Data Protection Act 1998. The Seller uses personal information volunteered during the registration process to provide various reporting features for the Online Development Tools to the Purchaser.  Personal information is stored on a secure server and is not passed on to third parties in any way.

Service Faults

The Seller will correct any service faults as soon as reasonably practicable, except problems external to the Online Development Tools. The Seller provides support to correct faults during normal business hours. The contact person designated by the Purchaser may telephone or e-mail the Seller. The Seller will endeavour to give the Purchaser reasonable notice of any downtime required for maintenance. The Seller makes no warranty that use of its website and the Online Development Tools is free from infection by viruses.

Technical Information

The website has been designed for use with Internet Explorer 5.5 - 7.0; Netscape 8; Firefox 1; Opera 8; Safari (Mac). Please note that, for user login, browsers must have per-session cookies enabled. Per-session cookies are used to store state information only within a session. These cookies are cached only while a user is visiting the Web server issuing the per-session cookie and are deleted from the cache when the user closes the session. The Purchaser's data will be backed up nightly. In the event of a system failure, recovery of data will be made from the most recent backup. The Client's data is held on a secure server with a UPS (Uninterruptible Power Supply) in an environmentally-controlled room. The server is located in a data centre utilising multiple connections to the internet through multiple carriers, should one ISP experience problems dual connections to the internet ensure the server remains online. It is technically impossible to provide a service free of faults. The Seller will remedy faults and omissions with due expediency.

Upgrades and Amendments

Any upgrades to the Online Development Tools during the Licence Period will be provided free of charge to the Purchaser. The Seller may amend these Terms and Conditions from time to time and the Purchaser is deemed to accept such changes as are notified to the Purchaser.

Force Majeure

The Seller shall not be liable for any loss or failure to perform any of its obligations to the Purchaser due to any cause beyond its reasonable control, including delay, breakdown or failure of computer facilities or systems; strikes or industrial action; war, terrorist act or civil disorder; or lightening, fire or flood.

Assignment

The Purchaser cannot sell or assign any Licence from the Seller to any third party.

Severance

If any provision of this Agreement is held to be illegal or unenforceable, the validity and enforceability of the remainder shall continue in full force and effect. 

Whole Agreement

The Purchaser acknowledges that this Agreement and the Licence Form contain the whole agreement between the parties and it has not relied upon any oral or written representation made to it by the Seller or its employees or agents.

Prior Agreements

This Agreement supersedes any prior agreement between the parties, whether written or oral.

Waiver

Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy or of any other right or remedy under this Agreement.

Notices

Any notice to be served on either of the parties by the other may be served by sending it by post, fax or e-mail to other’s registered or other address. Such notice shall be deemed to have been received by the addressee within 72 hours of posting or 24 hours if sent by fax or by electronic mail to the correct fax number or electronic mail address.

Cancellation

Any Purchaser who is a consumer within the Consumer Protection (Distance Selling) Regulations 2001 may cancel this Agreement before receiving any Online Development Tools by notice in writing by fax or e-mail to the Seller.

Termination

This Agreement will terminate upon expiry of the Licence or provision by the Seller of the Online Development Tools for which the Purchaser has paid, whichever is later. The Seller may terminate this Agreement, upon 14 days notice in writing, if the Purchaser fails to make any payment due to the Seller, if the Purchaser becomes bankrupt or insolvent, or if the Purchaser is otherwise in breach of these Terms and Conditions. All accrued rights, indemnities and exclusions in this Agreement shall survive the expiry or termination of this Agreement.

Liability of Seller

The Seller is not liable for direct or indirect loss caused by decisions which the Purchaser or any user may make as a result of using the Online Development Tools. The Seller is not liable for direct or indirect loss caused by the installation, use, misuse or de-installation of the Online Development Tools. A person who is not a Purchaser has no rights against the Seller under the Contracts (Rights of Third Parties) Act 1999.

Law

This Agreement is governed by English law and both parties submit to the exclusive jurisdiction of the English courts.
